1) This Agreement

This agreement describes the terms and conditions applicable to your access to and use of the services at MyPublicSite.com. We may amend this agreement at any time. We will implement the change by posting the amended terms on our site, and the revised version shall automatically replace the terms of this agreement. We will usually notify you of the changes via email. Your continued use of this site following the posting of a revised agreement will constitute your acceptance of the revised agreement. If you do not agree to the terms of this agreement or any revised version of the agreement, do not continue to use the services or this site. MyPublicSite.com is not obligated to refund all or any portion of your membership fee (if applicable)  if you discontinue use of the services at MyPublicSite.com before your membership term expires.

2) Privacy

Registration data and other information about you is subject to our Privacy Policy. Acceptance of our privacy policy is a requirement of this user agreement. 

3) Membership Eligibility

Our membership and services are available only to individuals who are 18 years of age or older.  You may only use our services if you can legally enter into and form binding contracts. If you do not qualify, you may not have access to or use our services.  As part of the registration process, you are required to provide your real name, address, and email information. You are also responsible for updating this information in a timely manner should any of the information change at any time. Additionally, your MyPublicSite.com membership may not be transferred or sold to another party. Any membership fee that MyPublicSite.com charges is an activation fee, and is non-refundable.

4) Type of Content Allowed

You may use our services for all of your site needs except for the following types of content.  

• adult content
• sexual content
• profane content
• illegal drugs or related content
• hate speech or hate graphics content

These subjects are not allowed and any site that is created with this type of content will be immediately removed and the account will be suspended.  In addition any site that violates any internet good conduct standards such as spamming will be suspended immediately.  In many cases complaints and issues can be resolved with our assistance and we highly encourage our members to request assistance in resolving complaints and issues.

5) Release and Waiver

You agree that your access to and use of the services at MyPublicSite.com is on an "as-is", "as-available" basis and we specifically disclaim any representations or warranties, express or implied. You understand that MyPublicSite.com is only a venue for the member to member and member to public exchange of information. MyPublicSite.com does not act as the agent of either party in any dispute and does not have the responsibility for resolving disputes. You release MyPublicSite.com from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

6) Legal Compliance

You shall comply with all applicable laws, statutes, ordinances, and regulations regarding your use of the services at MyPublicSite.com. You agree not to use MyPublicSite.com for any unlawful purpose. We reserve the right to terminate or restrict your access to MyPublicSite.com if, in our opinion, your use of MyPublicSite.com may violate any laws, infringe upon another person's rights or violate the terms of this agreement. Also, we may refuse to grant or ask you to change a username that impersonates someone else, is protected by trademark or other proprietary right law, or is in our opinion vulgar or otherwise offensive.

8) Intellectual Property

We own the intellectual property rights to our site.

9) Miscellaneous

This agreement is entered into in the State of Wisconsin and shall be governed by and construed in accordance with the laws of the State of Wisconsin, exclusive of its choice of law rules. Subscriber submits to the exclusive jurisdiction of the state and federal courts sitting in the County of Dane in the State of Wisconsin, and waives any jurisdictional, venue, or inconvenient forum objections to such courts. In any action to enforce these Terms and Conditions, the prevailing party will be entitled to costs and attorneys fees. In the event that any of the Terms and Conditions are held by a court or other tribunal of competent jurisdiction to be unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that these Terms and Conditions shall otherwise remain in full force and effect.
